Enrolment and participation in CircArts activities is based on agreement to the following terms and conditions.
By participating in any activities with CircArts, you confirm you have read, you understand and you do and can legally agree to the Terms and Conditions outlined on this page.

 

CIRCARTS TERMS AND CONDITIONS

1. ASSUMPTION OF RISK, WAIVER OF LIABILITY
By enrolling myself or my child in classes or activities with CircArts Pty Ltd, I RECOGNIZE AND FULLY UNDERSTAND THAT POTENTIALLY SEVERE INJURIES, INCLUDING PERMANENT PARALYSIS OR DEATH can occur in sports or activities involving height or motion, including but not limited to circus, gymnastics, tumbling, trampoline, martial arts, dance, aerial skills, cheerleading, birthday parties, open gym, etc. These Risks and dangers may be caused by my own or my child’s actions, or inactions, the actions or inactions of others participating in the Activity, or the negligence of CircArts Pty Ltd, officers, employees, or other representatives, whether paid or volunteer. BEING FULLY AWARE OF THESE DANGERS AND IN CONSIDERATION of the minor being permitted to participate in activities at this facility, I FULLY ACCEPT AND ASSUME ALL SUCH RISKS AND RESPONSIBILITY FOR LOSSES, COSTS, AND DAMAGES I, or my child, incur as a result of myself or my child’s participation in the activities provided by CircArts Pty Ltd. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS CircArts Pty Ltd and its employees and representatives, on my own behalf and the behalf of my child and our respective heirs, administrators, executors, and successors, its officers, directors, shareholders, employees or other representatives, whether paid or volunteer, FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES, WITHOUT LIMITATIONS, ON THE MINOR’S ACCOUNT OR MINE caused or alleged to be caused in whole or in part by the negligence of CircArts Pty Ltd, its officers, employees, agents or other representatives to the fullest extent permitted by law.

To provide adequate circus training, it is necessary for teachers to physically coach in the development of student technique, movement and placement, which may require strictly appropriate physical contact between teaching staff and students. It is also understood that any sort of development cannot occur without a formal and structured approach to all classes administered by CircArts Pty Ltd and its’ employees and representatives. All teaching staff are appropriately skilled in the delivery of circus tuition and while CircArts Pty Ltd will not be held responsible for any injuries which may occur whilst participating in training or other activities provided by CircArts Pty Ltd, CircArts Pty Ltd employees and representatives will seek medical attention or administer basic first aid for your child or you immediately if needed.


2. PERMISSION TO PHOTOGRAPH AND RELEASE
By enrolling myself or my child in classes or activities with CircArts Pty Ltd, I give permission for myself / my child to be photographed (including still, video and sound) as a participant in CircArts Pty Ltd activities and consent to the reproduction, use, and distribution thereof for any educational purpose and for promotion, advertising, trade, and outright bragging about CircArts Pty Ltd programs, activities and its wonderful students!

CircArts Pty Ltd reserve the right to sell videos of students who participate in the end of year performances, other performances, training and/or group photos throughout the year.

Original photographs/videos taken by staff are held securely by CircArts Pty Ltd and used for business purposes only. All CircArts Pty Ltd students are expected to perform in all scheduled performances, unless otherwise stated. By participating in this event you are giving consent for CircArts Pty Ltd to use photographs and/or video footage of the student for promotional purposes e.g. website, newspapers, events, social media or flyers.

3. PAYMENT POLICIES
By enrolling myself or my child in classes or activities with CircArts Pty Ltd, I hereby agree that I am responsible for all costs incurred but not limited to tuition and associated expenses and the collection of any delinquent payments, including but not limited to collection/legal /court costs, etc

It is agreed that Tuition, membership and other associated fees will be paid in full prior to participation in classes or activities. Payment plans are available at the discretion of the Directors. Semester and Term durations are set by CircArts Pty Ltd. All fees must be paid in full prior to commencing any term or semester at CircArts pty Ltd.

It is understood that there are NO REFUNDS on any payment of fees such as but not limited to tuition, enrolment fees, show fees, costume hire, uniform payment and DVD order, unless unforeseeable circumstances mean that classes must cease and no other training options are provided by CircArts at the direction of the Director or drastic personal circumstances have occurred. In any case, plenty of communication must occur between student, parent and teachers in these sorts of circumstances.

It is understood that an annual, non-refundable registration fee applies to all students at the commencement of their enrolment date. $50 for all students. The CircArts Uniform is compulsory and required to be worn to all classes by all students under 18 years of age. Current uniform fees will be advised at the time of purchase.

It is understood that students participating in classes with CircArts Pty Ltd may be expected to represent CircArts Pty Ltd in competitions and performances throughout the year. These may involve further costs such as; rehearsals, costume hire fees and entry fees. These classes may also require students to complete additional classes on occasion to ensure technique is maintained.

Payment reminder notices are emailed automatically on a regular basis.

Please ensure your email address is on file. Our class management systems and communications are managed online, as such all parents/students must subscribe to the CircArts Online Portal for the duration of their membership.

Tuition fees do not include costs for events, costumes or any uniform items. The tuition fees are applied for the coaching/tuition provided and use of CircArts related equipment only. 

Event fees such as but not limited to ticketing and costume rental will be advised and charged where applicable.

Class fees cannot be prorated due to your or your child’s absence - there are no credits or refunds for missed classes. Students may make-up missed classes by attending other similar level classes at no charge, by prior arrangement with CircArts reception staff (maximum of 2 make up classes per school term - this includes private lessons that are cancelled by the student.). A courtesy email, phone call, Facebook message or text message or logging of the absence in the online portal is expected for all absences. Positions will be jeopardised if students are noted to have missed a significant amount of classes without a formal explanation.

4. All items produced by CircArts Pty Ltd (including original music edits, choreography, concepts, costumes, props and sets, class delivery, lesson plans, curriculums) remain the property CircArts Pty Ltd and cannot be replicated or reproduced.

5. It is the discretion of the Director, employees and representatives of CircArts Pty Ltd as to which students are given opportunities to compete, perform or enrol in classes throughout the year.

6. All parents & adult students are responsible for remaining up to date with studio information. Our primary method of communication is Email, however there are many avenues available to stay informed; Newsletters, Email, Facebook & Instagram updates, our website and Online Portal. During the period of enrolment and participation at CircArts Pty, it is the responsibility of the parent or guardian or adult student to advise the Director if personal circumstances and/or information change. Please ensure contact details are always up to date on our online system.

7. CircArts Pty cannot be held responsible for any property lost or damaged on the premises.

7. All students & parents must behave in a respectable manner towards all employees and representatives of CircArts Pty both inside the studio & out. Any kind of rude or disrespectful behaviour will result in the immediate expulsion of the student, forfeiting any term or advance payment. All students & parents must respect all decisions made by the Director of the studio.


9. AUTHORIZATION TO TREAT A MINOR
By enrolling my child in classes or activities, I (we) the parent, parents, or legal guardian of a minor child enrolled in classes or activities with CircArts Pty Ltd, authorize and consent to any emergency transportation directed for my child in the event she/he is injured while participating in classes or activities at CircArts Pty Ltd. I authorize and consent to any x-ray examination, anaesthetic, medical or surgical diagnosis rendered under the general or special supervision of any member of the medical staff and emergency room staff. It is understood that this authorization is given in advance of any specific diagnosis, treatment or hospital care being required, and is given to provide authority and power to render care. It is understood that every effort shall be made to contact the undersigned prior to rendering treatment to the patient, but that the above treatment will not be withheld if the undersigned cannot be reached.

10. MEDICAL INFORMATION. 
I acknowledge that it is my responsibility to keep my own/my child’s medical information including medical restrictions, allergies and injuries up to date in CircArts Pty Ltd systems and with reception and coaching staff at all times.

This consent shall remain effective for as long as the above-mentioned minor is actively participating in lessons or activities with CircArts Pty Ltd or until affirmatively revoked by the Parent or Legal Guardian.
